Privacy Policy

This Privacy Policy explains how MediaGo (“MediaGo” “we” “us” or “our”) collects, processes, uses, and discloses personal information in connection with our websites (the “Sites”) and the related content, products, services, and other functionality offered on or through the online services, including where you interact with MediaGo through mobile applications and/or websites that have integrated with MediaGo’s advertising platform either directly or via an advertising exchange. It does not address our privacy practices relating to MediaGo job applicants, employees and other personnel.

1. About MediaGo

MediaGo is an advertising platform that enables advertisers to serve advertisements on third-party mobile applications and/or websites owned or operated by partners or to which a partner has the right to serve advertising (together with the “Sites”, the “Services”). We are an official vendor of Interactive Advertising Bureau (IAB) Europe’s Transparency and Consent Framework (TCF).

We collect personal information about individuals who visit our Sites. We also collect information on Customers’ and prospective Customers’ business representatives, who are advertising business partners, such as advertisers and publishers (“Customers”). Lastly, we collect personal information about individuals who visit Customer websites ("Users") in order to tailor and measure the effectiveness of the advertising displayed to you on Customers' websites and to advertise our Customers' products and services.

2. Information We Collect

We collect personal information about individuals in a number of ways, including automatically when an individual interacts with our Sites or Services and directly from an individual. We also collect information about our Customers.

2.1 Personal Data We Collect about Users

Our Services enable Customers to tailor and measure the performance of the ads played or displayed to you on Customers' websites and apps and on other websites, apps, or services.

The ads you see online are tailored to your interests based on information collected about you, including information about your location, as well as information about your internet usage over time, such as the websites you visit, the products and pages you view and the links you click on (including links in ads played or displayed to you).

To tailor the online advertising we serve and measure its effectiveness, we collect the following personal information:

  • A unique identifier (e.g., cookie ID, session ID, customer ID) assigned to you by the Customer or by MediaGo. The purpose of these identifiers:serving advertisements (personalized or otherwise) and facilitating advertising measurement/attribution to better optimize or otherwise understand the effectiveness of ad campaigns.
  • Your approximate location based on your IP address. We use this information to determine which advertisements to show you on the pages you are viewing.
  • Information about your activity on Customer websites, including the pages you visit, the keywords you search for on the Customer website, how long you spend on a Customer website, the products you view and purchase on a Customer website, the prices of the products viewed or purchased, the category of products viewed or purchased, number of products purchased, currency of the transaction, and product and order ID. We use this information to identify products and services you may be interested in, so that we can tailor the advertising shown to you online.
  • Information about the way you access and use our Services, for example, the site from which you came and the site to which you are going when you leave our Services, how frequently you access the Services, whether you access the Services from multiple devices, and other browsing behavior and actions you take on the Sites, so that we can tailor the advertising shown to you online.
  • Information about your device, such as device type and model, unique device identifying numbers, operating system, screen size, browser type, and browser window size. We use this information to determine which adverts to show you on the pages you are viewing.
  • Analytics information. We may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for the Services and to understand more about the demographics of our users. How you interact with the online advertising we show you, including the advertisement shown to you, whether you view or click on that advert, and whether you subsequently visit and make a purchase on a Customer website advertised to you. We use this information to measure the effectiveness of the online advertising we provide and inform the development of our online advertising strategy and to identify products and services you may be interested in, so that we can tailor the advertising shown to you online.

2.2 Personal Information Collected From our Customers and their Authorized Users and Website Visitors

We may collect the following personal information from our Customers and their Authorized Users and Website Visitors:

  • Customer Contact Information, including name, email address, company name, job title, country/region, state/region and communication preferences. We also collect any information you provide in custom messages sent to us.
  • Customer Account Information, including name, company name, job title, email address, login credentials, profile information, dashboard information, campaign information (including ad content, the platform used, and budget information), postal address, payment and purchase history information, payment card information, and any other information you provided to us. Please note we utilize a third-party provider to process payments on our behalf and do not accept payment directly through our Sites. As such, we do not retain any financial account information, such as credit card numbers. Rather, all such information is provided directly by you to our third-party processor. We do, however, receive information form the payment processors regarding your transaction such as order ID, payment amount, payment time, payment status (success/failure), and email address. The payment processor’s use of your personal information is governed by their privacy policy.
  • Inferences About Individuals’ Interests, Preferences, and Other Behavioral Data, including hobbies, characteristics, and purchases.
  • Automatically Collected Personal Information: If you access the Services on behalf of a Customer, or visit our website, we, and our third-party partners, automatically collect information you provide to us and information about how you access and use the Services when you visit our services or otherwise engage with us. We typically collect this information through technologies”) a variety of tracking technologies, including (i) cookies or small data files that are stored on an individual’s computer and (ii) other, related technologies, such as pixels and logging technologies (collectively, “tracking technologies”) and we may use third-party partners or technologies, such as Google Analytics to collect this information.   • We, and our third-party partners, use tracking technologies to automatically collect usage and device information, such as:
    • Information the computer, tablet, smartphone or other device you use, such as your IP address, browser type, operating system, date and time stamp, and a unique ID that allows us to uniquely identify your browser, mobile device, or your account and other such information. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which may permit us to recognize and contact you across multiple devices.
    • Information about the way you access and use our Services, for example, the site from which you came and the site to which you are going when you leave our services, how frequently you access the Services, whether you access the Services from multiple devices, and other browsing behavior and actions you take on the Sites.
    • Information about how you use the Services, such as the pages you visit, the links you click, and other similar actions. We may also use third-party tools to collect information you provide to us or information about how you use the Services and may record your clicks and keystroke activity on the Services and other browsing, search or purchasing behavior. These tools may also record information you enter when you interact with our Services.
    • Information about your location, such as general geographic location that we or our third-party providers may derive from your IP address.
    • Analytics information. We may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for the services and to understand more about the demographics of our users. All of the information collected automatically through these tools allows us to improve your customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our Sites and Services, and to improve the effectiveness of our Services, offers, advertising, communications and customer service. We may also use this information the data collected through tracking technologies to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including personalized content and advertising; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our services; (e) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website; (f) diagnose or fix technology problems; and (g) otherwise to plan for and enhance our services.

2.3 Personal Information from Third Parties

We also obtain personal information about Customers, Users, or Website Visitors from third parties, which we often combine with personal information we collect either automatically or directly from you.

We may receive the same categories of personal information as described above from the following third parties:

  • Your Employer / Company: When an individual interacts with our Services as an employee or representative of their company, we may receive their information from their employer or other employees at their company.
  • Our Customers/Ad Partners: We may receive your information from our Customers, ad partners, or other individuals who interact with our Services.
  • Service Providers: Our service providers that perform services solely on our behalf, such as payment processors or survey and certain advertising/marketing providers, collect personal information and may share some or all of this information with us.
  • Other Sources: We may also collect personal information about individuals that we do not otherwise have from, for example, publicly available sources, third-party data providers, brand partnerships, or through transactions such as mergers and acquisitions.

3. Additional Uses of Personal Information

We may use the personal information we collect to:

  • To fulfill your requests and provide our Services to you. This includes:
    • Making ourServices, including our ad services and MediaGo products, available to you and our Customers and partners.
    • Serving you with relevant and personalized advertisements and understanding the audiences who see the advertisements we serve.
    • Auditing and reporting.
    • Providing ad campaign analytics to our Customers.
    • Cross-device targeting to link or resolve the same user across their various devices.
    • Coordinating access to Customers’ account.
    • Responding to requests, suggestions, questions, and comments, and providing other types of user support.
    • Fulfilling Customers’ payments and transactions.
    • Sending Customers service/transaction-related messages, such as changes to Customers’ account.
    • Communicating about, and administering your participation in, programs, contests, surveys, and other offers or promotions.
  • For marketing and advertising purposes. We may send Customers communications about new features, updates, products, and special offers. We may also use Customer information to serve ads about our products or other products or services we (or our advertising partners, such as other third-party brands) think our Customers might find interesting. We may also use individual and aggregate information about our Customers to inform our marketing and advertising campaigns.   • To personalize your experience on our Services and tailor content. We use personal information to tailor the content that we display on our Sites in order to provide users with a personalized experience.
  • To communicate with our Customers. We use Customers’ information to communicate with our Customers about Customers’ account activities, to introduce our new products, to respond to Customers’ inquiries, requests, or complaints, and to introduce our product updates. We may communicate with Customers by email.
  • To monitor, improve, and develop our products and services. We use personal information to understand our website visitors, users, and Customers and to tailor or optimize our Services. For example, we may analyze statistics and trends to make our Services better, to develop the Services or new services and features, to display how many Customers use our dashboard, or to show which webpages on our Sites you have viewed. This information helps MediaGo analyze what features our users and Customers are interested in.
  • To protect the security and integrity of our business, comply with legal requirements and obligations, or as otherwise permitted by law.  We may use information to protect our company, our affiliates, our customers, and our Services. We may also use information in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, protect and defend our rights and property, or the rights or safety of third parties, enforce our Terms of Use, this Privacy Policy, or agreements with third parties, detect and prevent fraud or for crime-prevention purposes, or for any other reason permitted by law. We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets and may use information in connection with or as an asset in such a corporate business transaction. Personal information may also be used in the event of insolvency, bankruptcy, or receivership.
  • For any other purposes with your consent, at your direction, or where notice is provided: We may use your personal information for any other purposes with your consent, at your direction, or where notice is otherwise provided.

4. How We Disclose Your Information

We may share your information in the following ways:

  • Certain members of the Baidu group. We may share information with our affiliate, Baidu Japan, Inc, in connection with the provision of intragroup services and use of centralized IT infrastructure. This company will use your personal information in the same way as we can under this Privacy Policy.
  • Service providers. This may include cloud services providers, consultants and other service providers that perform services on our behalf, in order to carry out their work for us, which may include identifying and serving personalized advertisements, content or service fulfilment, or providing analytics services.
  • Future parties to the Baidu group. Other parties in connection with any MediaGo or Baidu company transaction, such as a merger, sale of all or a portion of company assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business by another company or third party or in the event of bankruptcy or related or similar proceedings.
  • Customers/Online advertising partners. We may share information with our Customers and third-party online advertising partners, including ad exchanges and demand side platforms (DSPs), or permit these Customers and partners to collect information from you directly on or through our Services to facilitate online advertising.
  • Third parties as required to. For example, to: (i) satisfy any applicable law, regulation, subpoena/court order, legal process or other government request, (ii) enforce our Terms of Use Agreement, including the investigation of potential violations thereof, (iii) investigate and defend ourselves against any third party claims or allegations, (iv) protect against harm to the rights, property or safety of MediaGo, its users or the public as required or permitted by law and (v) detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.
  • With your consent or at your direction. In addition to the sharing described in this Privacy Policy, we may share information about you with third parties whenever you consent to or direct such sharing.

In connection with any of the above, we may share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you.

5. Data Retention

We will usually store the personal information we collect about you for no longer than necessary to fulfil the purposes for which it was collected, and in accordance with our legitimate business interests and applicable law. However, if necessary, we may retain personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and accounting requirements set by a legislature, regulator or other government authority.

To determine the appropriate duration of the retention of personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting and other applicable obligations.

Once retention of the personal information is no longer necessary for the purposes outlined above, we will either delete or deidentify the personal information or, if this is not possible (for example, because personal information has been stored in backup archives), then we will securely store the personal information and isolate it from further processing until deletion or deidentification is possible.

6. Third-Party Links

The Services operate on third party websites and may contain links to third party websites of our business partners, advertisers, social media sites, and our customers may post links to third party websites. If you follow a link to any of these websites, or browse on our customers’ websites, please note that these websites have their own privacy notices and policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.

7. Children’s Personal Information

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If an individual is under the age of 13, they should not use our Services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal information from our systems. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.

SENSITIVE INFORMATION

We collect the following personal information elements from Customers which may be classified as “sensitive” under certain privacy laws (“sensitive information”): account log-in in combination with any required security or access code, password or credentials allowing access to the account.

We use this sensitive information for the purposes set forth in our Privacy Policy. We do not use or disclose sensitive information for any purpose other than for what would reasonably be expected in connection with the Services, for detecting security incidents, fraud and other illegal actions, or for short term transient use. We do not sell sensitive information, and we do not process or otherwise share sensitive information for the purpose of personalized advertising.

DEIDENTIFIED INFORMATION

We may at times receive, or process personal information to create, deidentified data that can no longer reasonably be used to infer information about, or otherwise be linked to, a particular individual or household. “Shine the Light”

To Exercise Your Right to Opt-Out of Personal Information “Sales” or Sharing for Personalized Advertising Purposes

Unless you have exercised your Right to Opt Out, and as described in the Sales of Personal Information or Sharing for Personalized Advertising section of these U.S. Disclosures, we may disclose or “sell” your personal information to third parties for monetary or other valuable consideration, or “share” your personal information to third parties for cross-context behavioral advertising purposes. The third parties to whom we sell or share personal information may use such information for their own purposes in accordance with their own privacy policies.

The third parties to whom we sell or share personal information may use such information for their own purposes, in accordance with their own privacy statements, which may include reselling or sharing this information to additional third parties.

You do not need to create an account with us to exercise your Right to Opt Out. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset and to track compliance with your opt out request. We will only use personal information provided in an opt out request to review and comply with the request. If you chose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

Authorized Agents

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth in these U.S. Disclosures where we can verify the authorized agent’s authority to act on your behalf.

We generally require the following for verification purposes:

  1. a valid power of attorney; or
  2. sufficient evidence to show that you have:
    1. provided the authorized agent signed permission to act on your behalf; and
    2. verified your own identity directly with us pursuant to the instructions set forth in these U.S. Disclosures; or directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

For requests to opt-out of personal information “sales”, we require a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.

Depending on the evidence provided and your state of residency, we may still need to separately reach out to you to confirm the authorized agent has permission to act on your behalf and to verify your identity in connection with the request.

Appealing Privacy Rights Decisions

Minors Under 16

We do not sell the personal information of consumers we know to be less than 16 years of age, unless we receive affirmative authorization (the “Right to Opt In”) from either the minor who is between 13 and 16 years of age, or the parent or guardian of a minor less than 13 years of age.
